Following is the language to be inserted into the Order Form terms for any ATS Design Partner Program participants:
Gem ATS Enterprise Design Partner Program. In connection with this Order, Customer agrees to join the “Gem ATS Enterprise Design Partner Program” (the “Design Program”). Customer agrees to be an active participant in the Design Program and commits to the following expectations:
- Quarterly ATS Customer Advisory Board Participation — Customer will send a representative such as a vice president of talent acquisition and a leader from recruiting operations to actively participate in a quarterly ATS customer advisory board meeting.
- Bimonthly feedback on our ATS roadmap — A representative from Customer’s recruiting operations team will meet with the Gem product team on a bimonthly basis to give feedback on features in development.
- Executive sponsorship — Customer agrees to make a leader such as their vice president of talent acquisition available for quarterly or bi-annual 1-1 meetings with Steve Bartel, Gem’s CEO, in order to discuss the Design Program and better understand the Customer’s evolving needs.
- Private Reference — Customer understands that at certain times, Gem may request that Customer be willing to provide a direct reference with other potential ATS customers to speak to the collaboration, partnership, our speed of development, experience with the rest of the Gem’s platform, and Customer’s experience as an ATS design partner. Customer agrees to work in good faith to provide such reference upon request.
While the commits above are non-binding, the Parties acknowledge that both Parties will invest substantial time and effort in the Design Program. Customer further acknowledges that the term of the contract offered in this Order, and the substantially discounted pricing, are offered in connection with the anticipated active participation in the Design Program.
